1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of equa (the "Service"), provided by Neodata Group S.p.A. ("Neodata", "we", "us", or "our").
By accessing or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms.
2. Definitions
In these Terms, the following definitions apply:
"Service" means equa, the AI-powered system provided by Neodata for querying and exploring European open data, including all related features, interfaces, and functionality.
"User", "you" means any individual or entity that accesses or uses the Service.
"Input" means the queries, prompts, text, and other data you submit to the Service.
"Output" means the responses, summaries, charts, insights, and other content generated by the Service in response to your Input.
"Content" means, collectively, Input and Output.
"Consumer" means a natural person acting for purposes outside their trade, business, craft, or profession.
3. Free Trial Disclaimer
equa is currently provided as a free trial version, available from 1 July 2026 to 14 September 2026. This means that:
- the Service is offered free of charge for the duration of the trial period;
- access is subject to the usage limits described in Section 6;
- the Service may be incomplete;
- features may change, be removed, or added at any time;
- performance, uptime, and response quality are not guaranteed.
By using equa, you acknowledge and accept that the Service is still under development and may evolve significantly over time.
4. Description of the Service
equa is an AI-powered system designed to assist users in querying, analyzing, and interacting with structured and unstructured data, with a focus on European open data sources.
The Service may include, among other features:
- natural language queries;
- automated data retrieval;
- AI-generated responses, summaries, charts, and insights.
5. User Responsibilities
You agree to use the Service lawfully and responsibly.
In particular, you agree that you will not:
- use the Service for unlawful, harmful, fraudulent, or misleading purposes;
- attempt to reverse engineer, copy, disrupt, or exploit the Service;
- interfere with the operation, security, or integrity of the Service.
You remain solely responsible for how you interpret, verify, and use any output generated by equa.
6. Fair Use and Usage Limits
To ensure fair access and sustainable operation during the free trial, the Service is subject to a fair use policy.
During the free trial period, each user is limited to a maximum of 100 queries. This limit applies to the entire free trial and is intended to guarantee balanced access across all users.
We reserve the right to:
- monitor usage to enforce this limit;
- suspend, throttle, or restrict access where usage exceeds the fair use limit or where we detect abuse, automated querying, or attempts to circumvent the limit;
- adjust the fair use limit at any time, with notice where reasonably practicable.
Usage limits are technical and operational measures and do not constitute a guaranteed service level.
7. AI-Generated Content
equa is an artificial intelligence system, and you are interacting with AI rather than a human operator. Outputs are generated automatically and are not reviewed by a person before delivery unless expressly stated.
equa generates responses using artificial intelligence and automated processing; as a result:
- outputs may be incomplete, inaccurate, ambiguous, or outdated;
- outputs should not be treated as legal, financial, scientific, or professional advice;
- users are responsible for independently verifying critical information before relying on it.
Neodata does not guarantee the correctness, completeness, or reliability of any output generated by the Service.
8. Data Sources and Non-Affiliation
equa draws on European public statistical data, including data published by Eurostat and ISTAT, processed through automated means. In case of any discrepancy, the original data published by the respective source shall prevail.
equa is a product of Neodata Group S.p.A. and is not affiliated with, endorsed by, or in any way officially connected with Eurostat, ISTAT, or the European Union. References to these sources are made solely to acknowledge the origin of the data.
9. Data Usage and Privacy
Neodata Group S.p.A. acts as the data controller in respect of personal data processed in connection with your use of the Service. By accessing or using the Service, you accept these Terms, which form a binding agreement between you and Neodata even though the free trial is provided at no charge. The queries and other input you submit ("Input") are processed solely in order to interpret your request, translate it into the corresponding database queries (for example, SQL statements) against the underlying open data sources, and return responses and outputs to you. The legal basis for this processing is the performance of these Terms (Article 6(1)(b) GDPR). The legal basis for processing necessary to operate, secure, and protect the Service against abuse is Neodata's legitimate interest (Article 6(1)(f) GDPR).
Anonymized or aggregated usage data may be used for product improvement, analytics, and service optimization.
Neodata does not use the content of your Input to train, fine-tune, or otherwise develop its artificial intelligence models. Your Input is used only to generate the response to your request and is not repurposed for model training. Should Neodata wish to use Input for model training or any other new purpose in the future, it will update these Terms and the Privacy Policy, identify a valid legal basis, and, where required, obtain your consent or provide you with the ability to object before any such processing begins.
You should avoid submitting sensitive, confidential, or regulated information unless explicitly authorized to do so.
To the extent that personal data is processed, you have the rights granted under applicable data protection law, including the rights of access, rectification, erasure, restriction, objection, and data portability, which you may exercise by contacting us at the address in Section 21. Input and associated log data are retained only for as long as necessary for the purposes described above or as required by law, after which they are deleted or anonymized.
For more information on how personal data is handled, please refer to our Privacy Policy.
10. Availability and Changes
We reserve the right, at any time and without prior notice, to:
- modify, suspend, or discontinue the Service or any part of it;
- limit or restrict access to the Service;
- update or remove features, content, or functionality.
We do not guarantee uninterrupted, secure, or error-free operation of the Service.
11. Intellectual Property
All rights, title, and interest in and to the Service, including the software, models, design, content, and underlying technology, remain the exclusive property of Neodata Group S.p.A. or its licensors.
Except as expressly permitted in writing, you may not reproduce, distribute, modify, or commercially exploit any part of the Service.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Neodata shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to your access to or use of the Service. Nothing in these Terms excludes or limits Neodata's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited under applicable law, including mandatory consumer protection law.
This includes, without limitation:
- loss of data, revenue, profits, or business opportunities;
- errors, inaccuracies, or omissions in outputs generated by the Service;
- decisions or actions taken based on information produced by equa.
Subject to the paragraph above on liability that cannot be excluded or limited by law, Neodata's total aggregate liability arising out of or in connection with these Terms and your use of the Service shall not exceed: (a) during the free trial period, the greater of the total amount (if any) paid by you for the Service and EUR 100; and (b) for the commercial version of the Service, the total amounts paid by you for the Service in the twelve (12) months preceding the event giving rise to the liability.
Your use of the Service is at your own risk.
13. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, especially in the event of misuse, abuse, or breach of these Terms.
14. Transition to Commercial Service
At the end of the free trial period (14 September 2026), equa will transition to a commercial service. Pricing, subscription plans, and licensing terms (including individual and business options) will be communicated separately before any charges apply. Continued use of the Service after the free trial period will be subject to the terms applicable to the commercial service.
15. Changes to These Terms
We may update these Terms from time to time. Any updated version will become effective as of the date indicated at the top of this page.
Your continued use of the Service after any such changes constitutes acceptance of the revised Terms.
16. Eligibility
The Service is intended for users who are at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
17. Consumer Right of Withdrawal
The free trial described in these Terms is provided free of charge and does not require payment. If you are a consumer and later enter into a paid contract for the commercial version of the Service (see Section 14), you may have a statutory right to withdraw from that contract within 14 days, without giving any reason, in accordance with applicable consumer protection law. We will provide clear information on how to exercise this right, an easily accessible electronic withdrawal function, and a confirmation of any withdrawal, before any charges apply. Where a digital service begins during the withdrawal period at your express request, the right of withdrawal may be lost or limited once performance has begun, as permitted by law.
18. Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be modified to the minimum extent necessary to make it enforceable or, if that is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
19. Force Majeure
Neodata shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, epidemics or pandemics, strikes, failures of telecommunications or internet networks, failures or interruptions of third-party data sources or hosting providers, power outages, or governmental action.
20. Governing Law
These Terms are governed by and construed in accordance with the laws of Italy, unless otherwise required by applicable law. The courts of Italy shall have jurisdiction over any dispute arising out of or in connection with these Terms. If you are a consumer, this does not deprive you of the protection of the mandatory provisions, or of the jurisdiction of the courts, of the country in which you reside.
